Completing land pricing policies in Vietnam

The Land Law 2013, Decree No. 44/2014/NĐ-CP on land prices, and Circular No. 36/2014/TT-BTNMT detailing land valuation methods, construction, adjustment of land price tables, specific land valuation, and land valuation consultancy have become important legal bases for the state to exercise its state management function over land. 

It is necessary to legalize land valuation methods 

The Land Law 2013, Decree No. 44/2014/NĐ-CP on land prices, and Circular No. 36/2014/TT-BTNMT detailing land valuation methods, construction, adjustment of land price tables, specific land valuation, and land valuation consultancy have become important legal bases for the state to exercise its state management function over land. However, in reality, land prices are always dynamic, changing significantly over time and space, making it difficult for the state to keep up with accuracy.

Initial results on the implementation of land valuation under Decree 44 and Circular 36 The research team conducted in-depth interviews with real estate business owners in Dak Lak province and grassroots officials (commune level) in Hai Duong province about some difficulties and shortcomings in the implementation of land valuation methods under Decree 44 and Circular 36.

Shortcomings in land pricing policies 

  • Land policies change constantly, lack consistency, and fail to provide reassurance to investors. 
  • Land prices do not align with market prices and land prices are not transparent. This causes losses in tax revenue and various repercussions. 
  • Provisions on land timing are inappropriate and need updating regarding transactions.

Land pricing policies should be completed, specifically

  • Establish specific regulations for land valuation methods. 
  • Building a database system to serve land valuation.
  • Improving mechanisms for managing the land market. 
  • Enhancing the capacity and ethics of land valuation officials. 
  • Emphasizing inspection and supervision in land valuation work.
